Allergen regulations: the countdown has begun, with Cosmed supporting manufacturers

À compter du 31 juillet 2026, l’étiquetage des allergènes dans les cosmétiques évolue en profondeur dans l’Union européenne. Le nombre de substances allergènes à mentionner obligatoirement passera de 24 à plus de 80. Ce que change le nouveau règlement

The new regulatory framework in Europe significantly broadens the scope by requiring the labelling of more than 80 substances where their concentration exceeds the regulatory thresholds of 0.01 per cent for rinse-off products and 0.001 per cent for leave-on products.

This development affects all stakeholders: manufacturers, subcontractors, importers and distributors. For businesses, achieving compliance involves, in particular:

  • checking the formulas;
  • updating labels;
  • updating the product information files (PIFs) where necessary.

From 31 July 2026, products that do not comply with the new allergen labelling requirements will no longer be allowed to be placed on the market.

Une échéance à bien comprendre : la “mise sur le marché”

There is one point that is often misunderstood by stakeholders: the concept of ‘placing on the market’ does not correspond to either the date of manufacture or the year in which a product is launched. Placing on the market refers to the act by which the Responsible Person (RP) makes a unit of the product available on the European market; in other words, the moment when the RP transfers the product to its distributors or directly to the consumer.

In practical terms:

  • in the case of subcontracted manufacturing within the EU, the product is not placed on the market until it has been fully finished and made available by the PR;
  • in the case of imports, the responsible person is, in principle, the importer, who may only place the product on the market once customs clearance procedures have been completed;
  • à partir du 31 juillet 2026, la PR ne pourra plus céder sur le marché de l’UE de nouvelles unités non conformes aux nouvelles règles d’étiquetage ;
  • les produits déjà mis sur le marché avant cette date pourront continuer à être écoulés jusqu’au 31 juillet 2028 date à laquelle il faudra retirer les produits du marché EU.
